Welcome to VVSKING ("VVSKING," "we," "our," or "us"). We respect your privacy and are committed to protecting your personal data. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our Site, interact with our marketing, or make a purchase from our jewelry store.

Data Controller: For purposes of the EU/UK General Data Protection Regulation (GDPR/UK GDPR), VVSKING is the data controller of your personal data. You can contact us at contact@vvsking.com.

By using our Site, you acknowledge the data practices described in this Policy. If you do not agree, please do not use the Site.

We collect the following categories of personal information (as defined under the California Consumer Privacy Act / California Privacy Rights Act):

Sensitive Personal Information (SPI): Because we deal in high-value luxury goods, we may request a government-issued photo ID to protect against fraudulent transactions on high-value orders. This is treated as Sensitive Personal Information under California law. We use it only for fraud prevention and identity verification, never for marketing or inferences. You have the right to limit our use of SPI (see Section 9).

We process personal data for the following business purposes:

• Processing, fulfilling, shipping, and confirming your orders.
• Providing customer support, sizing assistance, modifications, and custom-order consultation.
• Screening orders for fraud, risk, and chargebacks.
• Marketing and advertising, including showing you relevant ads on social media and search platforms.
• Analytics and improving our Site, products, and customer experience.
• Sending transactional emails (order confirmations, shipping updates, returns).
• Sending marketing emails or SMS messages, where you have opted in.
• Complying with legal obligations, tax requirements, and law enforcement requests.
• Defending and exercising legal claims.

Legal bases under GDPR/UK GDPR: Where GDPR applies, we rely on the following legal bases:

• Contract (Art. 6(1)(b)) — to fulfill your purchase and provide customer service.
• Legal obligation (Art. 6(1)(c)) — for tax, accounting, and fraud-prevention recordkeeping.
• Legitimate interests (Art. 6(1)(f)) — for fraud prevention, analytics, and securing our Site.
• Consent (Art. 6(1)(a)) — for non-essential cookies, marketing emails, and SMS marketing.

We use cookies, web beacons, software development kits (SDKs), and similar tracking tools, including:

• Strictly necessary cookies — required for the Site to function (cart, checkout, login).
• Analytics cookies — Google Analytics.
• Advertising cookies and pixels — Meta (Facebook) Pixel, including server-side Conversions API, and similar tools from Google, TikTok, or Pinterest where applicable.

What the Meta Pixel and similar tools share: When you visit the Site, these tools may transmit page-view events, button clicks, add-to-cart events, checkout events, purchase amounts, and hashed identifiers (such as a hashed version of your email) to the relevant ad platform. This transmission may qualify as "sharing" or a "sale" of personal information under certain state privacy laws.

Your cookie choices:

• Cookie banner: When you first visit the Site, you will be presented with a cookie banner allowing you to accept or reject non-essential cookies. You can change your preferences at any time via the "Cookie Settings" link in the Site footer.
• Global Privacy Control (GPC): We honor opt-out preference signals sent by browser-based GPC settings as a valid opt-out of "sale" and "sharing" for California, Colorado, and Connecticut residents.
• Browser controls: You may also adjust your browser settings to refuse cookies, but Site functionality may be affected.
• Ad platform opt-outs: You can opt out of interest-based ads from Meta at facebook.com/settings/?tab=ads and from Google at adssettings.google.com.

Do Not Track: Our Site does not currently respond to browser DNT signals because there is no industry standard for them.

Email: If you opt in to marketing emails (or by purchasing from us, where permitted by applicable law and our checkout disclosure), we may send you promotional emails. Every marketing email contains an unsubscribe link, and you may also email contact@vvsking.com with the subject "Unsubscribe." We comply with the CAN-SPAM Act.

SMS/Text messages: If you opt in to SMS marketing by providing your mobile number and affirmatively consenting (e.g., checking a checkbox or texting a keyword), we may send recurring marketing texts. Message and data rates may apply. Message frequency varies. Consent is not a condition of purchase. Reply STOP to cancel or HELP for help. We comply with the Telephone Consumer Protection Act (TCPA).

We do not sell your personal data for money. We share personal data only with the following categories of recipients:

• E-commerce platform: Shopify Inc. (storefront hosting, checkout, payment processing)
• Payment processors: Shopify Payments, PayPal, and similar processors (full card data handled directly by them)
• Shipping carriers: FedEx, UPS, USPS, and other insured carriers
• Fraud prevention services: Shopify Fraud Protect and similar risk-screening providers
• Marketing and analytics providers: Google (Analytics, Ads), Meta (Pixel, Conversions API, Business Suite), Klaviyo or similar email/SMS platforms
• Identity verification providers: Third-party services that assist us in verifying high-value orders
• Professional advisors: Lawyers, accountants, insurers, and auditors, under confidentiality obligations
• Government and law enforcement: Where required by subpoena, court order, or other legal process
• Successor entities: In the event of a merger, acquisition, financing, reorganization, bankruptcy, or sale of all or part of our business, personal data may be transferred to the successor entity, subject to the same protections set out in this Policy

"Sale" and "Sharing" under state law: Our use of advertising pixels (such as the Meta Pixel) and analytics for cross-context behavioral advertising may qualify as a "sale" or "sharing" of personal information under the California Consumer Privacy Act, the Virginia Consumer Data Protection Act, the Colorado Privacy Act, and similar state laws. You have the right to opt out (see Section 9).

VVSKING is based in the United States. Our service providers (including Shopify, Google, and Meta) primarily store and process data in the United States. If you access the Site from outside the U.S., your personal data will be transferred to, stored, and processed in the U.S.

For transfers of EU, UK, or Swiss personal data to the United States, we rely on appropriate safeguards such as the EU Standard Contractual Clauses (and the UK Addendum where applicable) in our contracts with our processors. You may request a copy of these safeguards by emailing contact@vvsking.com.

• Order and transaction data: 7 years (tax and accounting compliance)
• Account and customer profile data: While account is active + 3 years after last activity
• Identity verification documents (ID images): 90 days after order resolution, then securely deleted
• Marketing email/SMS subscriber data: Until you unsubscribe or request deletion
• Customer support tickets and correspondence: 3 years after resolution
• Cookie and tracking data: Up to 24 months from last interaction
• Device and log data: Up to 24 months

After applicable retention periods expire, we delete or anonymize the data.

Rights available to all U.S. residents covered by a comprehensive state privacy law:

• Access / Right to Know — request a copy of the personal data we hold about you
• Correction — request correction of inaccurate data
• Deletion — request deletion of your personal data, subject to legal retention requirements
• Portability — receive your data in a portable, machine-readable format
• Opt-out of Sale / Sharing / Targeted Advertising — opt out of our use of pixels and similar tools for cross-context behavioral advertising
• Limit Use of Sensitive Personal Information (California) — limit our use of SPI (such as government ID) to the purposes necessary to provide the goods or services you requested
• Right against automated decision-making / profiling — opt out of profiling that produces legal or similarly significant effects
• Non-discrimination — we will not discriminate against you for exercising your rights
• Appeal — if we deny your request, you have the right to appeal our decision within 45 days

Rights under EU/UK GDPR (if applicable): Access, rectification, erasure ("right to be forgotten"), restriction of processing, data portability, objection to processing, and the right to lodge a complaint with a supervisory authority.

Rights under Illinois law: Illinois Personal Information Protection Act (PIPA) rights regarding breach notification. We do not currently collect biometric data under BIPA rules.

We implement commercially reasonable technical, administrative, and organizational safeguards designed to protect your personal data against unauthorized access, loss, misuse, or disclosure. These include encryption in transit (TLS), restricted access controls, vendor due diligence, and use of PCI-DSS-compliant payment processors.

However, no method of transmission over the internet is 100% secure. In the event of a data breach affecting your personal information, we will notify you and applicable regulators as required by law, including the Illinois Personal Information Protection Act, in the most expedient time possible and without unreasonable delay.

Our Site and products are intended for adults. We do not knowingly collect personal data from children under 13 in violation of the Children's Online Privacy Protection Act (COPPA), and we do not knowingly market to or collect personal data from individuals under 16 in violation of the GDPR.

We do not knowingly accept purchases from individuals under 18 without verified parental consent. If you believe we have inadvertently collected data from a minor, please contact us immediately at contact@vvsking.com and we will delete the information.

Our Site may contain links to third-party websites, services, or social media platforms. We are not responsible for the privacy practices of those third parties. Please review their privacy policies before providing them with your information.

We may update this Privacy Policy from time to time. We will post the revised Policy on this page with a new "Effective Date." For material changes, we will provide additional notice, such as an email to subscribers or a banner on the Site, at least 30 days before the change takes effect where required by law. Your continued use of the Site after the effective date constitutes acceptance of the revised Policy.

By accessing or shopping at VVSKING (https://thevvsking.myshopify.com/), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the Site or purchase our products.

You must be at least 18 years of age (or the age of majority in your jurisdiction) and legally able to enter into a binding contract to make a purchase. We reserve the right to update these Terms at any time. Material changes will be posted to this page with a new Effective Date. Your continued use of the Site after the Effective Date constitutes acceptance of the revised Terms.

By using the Site or making a purchase, you consent to receive communications from us electronically (email, SMS where opted in, and notices posted on the Site) and agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communications be in writing, consistent with the federal E-SIGN Act.

We make every effort to display the colors, dimensions, weights, gemstone grades, and details of our jewelry as accurately as possible. However, because metal reflections, diamond brilliance, and gemstone color depend on lighting, photography, and your device screen settings, we cannot guarantee perfect accuracy of color or detail on your screen. Product descriptions are provided in good faith but do not constitute express warranties unless explicitly stated.

3.1 FTC Jewelry Guides Disclosures

VVSKING complies with the FTC Guides for the Jewelry, Precious Metals, and Pewter Industries (16 C.F.R. Part 23). When applicable:

• Precious metals are described by karat (e.g., 14K, 18K) or fineness (e.g., 925 sterling silver). Plated, filled, bonded, or vermeil items are disclosed using FTC-compliant terminology.
• Diamonds are identified as "natural" (mined) or "laboratory-grown" (synthetic), with no ambiguous terminology.
• Gemstone treatments (heat treatment, irradiation, fracture filling, clarity enhancement, dyeing, oiling, diffusion, etc.) are disclosed where present.
• Grading: Where we provide diamond grading (e.g., 4Cs), we identify the grading laboratory (GIA, IGI, GCAL, etc.) and provide certification where applicable.

3.2 Conflict-Free Sourcing

VVSKING does not knowingly purchase or sell conflict diamonds. To the best of our knowledge, our diamonds are sourced from suppliers who certify compliance with the Kimberley Process Certification Scheme and the World Diamond Council's System of Warranties.

• Currency: All prices are listed in U.S. Dollars unless stated otherwise.
• Pricing errors: Prices and product information are subject to change without notice. In the event of an obvious pricing error or typographical mistake, VVSKING reserves the right to cancel the affected order (with a full refund) even after order confirmation.
• Taxes: Sales tax will be calculated and added at checkout based on the shipping address and applicable law.
• Duties and customs: For international orders, the customer is responsible for any import duties, customs fees, taxes, or charges imposed by the destination country.
• Payment: We accept payment methods listed at checkout. You represent that any payment method you use is yours or that you are authorized to use it.

Custom jewelry: Custom-designed pieces, personalized engravings, and special-order items are subject to separate design approval and are final sale once production begins, except where the item is defective or materially misrepresented (see Section 7).

Sizing: It is the customer's responsibility to provide accurate sizing (ring size, chain length, bracelet length). VVSKING is not liable for fit issues caused by incorrect sizing provided by the customer. Resizing services may be available for an additional fee.

• Risk of loss: Title and risk of loss pass to you upon delivery by the carrier to the shipping address you provided.
• Signature required: Due to the high value of jewelry, VVSKING reserves the right to require an adult signature upon delivery. You will be notified at or before checkout.
• Delivery confirmation: Once a package is marked as "Delivered" by the carrier with the required signature confirmed, VVSKING is not liable for lost or stolen packages.
• Shipping delays: VVSKING is not responsible for carrier delays, weather events, acts of nature, customs holds, strikes, pandemics, or other events outside our reasonable control.
• Insurance: Shipments may be insured at our discretion; details will be provided in your order confirmation. You may request additional insurance at additional cost.

Standard items: We offer a 15-day return window for unworn, unaltered items in their original packaging with all certificates and tags. The window begins on the date the carrier marks the item as delivered.

Initiating returns: Email contact@vvsking.com within 15 days to request a Return Merchandise Authorization (RMA). Unauthorized returns will not be accepted.

Return shipping: For standard (non-defective) returns, the customer is responsible for return shipping, including full insurance for the value of the item. For defective or incorrect items, VVSKING provides a prepaid, insured return label.

Refund timeline: Approved refunds will be processed within 10 business days after we receive and inspect the returned item, back to the original payment method.

Final-sale items: All sales are final on custom-made, engraved, resized, or otherwise modified items. However, this restriction does not apply to items that are defective or materially differ from their description.

Defective items: If you receive a defective or incorrect item, contact us within 15 days of delivery for a replacement, repair, or refund.

If you create a customer account, you agree to:

• Provide accurate and complete information.
• Maintain the confidentiality of your password and account credentials.
• Be responsible for all activity that occurs under your account.
• Notify us immediately at contact@vvsking.com of any unauthorized access.

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently or in bad faith.

You agree not to use the Site for any unlawful, fraudulent, or harmful purpose; reverse engineer, scrape, or attempt to access non-public areas; use automated systems (bots, scrapers, spiders) without permission; or submit false, misleading, or fraudulent orders.

If you submit reviews, photos, comments, or other content ("User Content") to the Site or our social channels, you grant VVSKING a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and display your User Content in connection with our business and marketing.

All content on the Site, including product images, designs, descriptions, logos, trademarks, and branding, is the property of VVSKING or its licensors and is protected by intellectual property laws.

DMCA Notice and Takedown: If you believe content on the Site infringes your copyright, send a formatted DMCA notice containing your physical/electronic signature, identification of the work, and location on our Site to contact@vvsking.com.

We reserve the right to refuse, cancel, or hold any order we suspect to be fraudulent, unauthorized, or unlawful. If your order triggers a high-risk fraud alert, we may cancel the order and refund within 5-7 business days, or contact you to request additional identity verification, including a government-issued photo ID, before shipping.

EXCEPT AS EXPRESSLY STATED IN THESE TERMS OR REQUIRED BY APPLICABLE LAW, THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. VVSKING DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VVSKING, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES. VVSKING'S TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

You agree to defend, indemnify, and hold harmless VVSKING and its owners, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms.

16.1 Informal Resolution: Before filing any arbitration, you agree to first send a written Notice of Dispute by email to contact@vvsking.com and attempt in good faith to resolve it for at least 30 days.

16.2 Binding Individual Arbitration: If informal resolution fails, any dispute shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in Illinois.

16.3 Class Action and Jury Trial Waiver: YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE IN ANY CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION.

16.4 Mass Arbitration: Coordinated fillings of 25+ similar claims will follow AAA's Mass Arbitration Supplementary Rules batching procedures.

16.5 30-Day Opt Out: You may opt out of arbitration by emailing us within 30 days of your first interaction.

17. Governing Law: State of Illinois laws govern these terms.

20. Promos & Gift Cards: Codes are limited to one per order, non-transferable, and cannot be redeemed for cash.

21. Force Majeure: Neither party is liable for failure or delays caused by acts of God, pandemics, or supply chain blockades.

22 - 25. Entire Agreement: These terms represent the total agreement and are severable if found partially invalid by a court.
